WARNING TO BE INFORMED OF TERMS AND CONDITIONS
Please be advised that you are required to CAREFULLY READ these Terms and Conditions for the use of 2512 Laundry Service (herein referred to as ‘2512LS’) website and related internet links and to engage the services BEFORE using the said site and engaging the related services.
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, PLEASE DO NOT ACCESS OR USE THIS WEBSITE AND RELATED PRODUCTS AND SERVICES HEREIN OFFERED. NEVERTHELESS, ONCE YOU DO ACCESS THESE SERVICES AND PRODUCTS YOU SHALL BE DEEMED TO HAVE AGREED TO THESE TERMS AND CONDITIONS.
These terms and conditions (herein referred to as the ‘Agreement’) apply to 2512LS, its employees and agents, its website and related products and services, collectively considered to be the Service. And wherever the words 2512LS, ‘we’, ‘our’, or ‘us’ are used herein shall mean 2512 Laundry Service.
By accessing or using the products and services provided by 2512LS, either as a member or a regular customer, you will be deemed to have agreed to this Agreement and to the gathering, use and disclosure of your information as set forth in our Private Policy document and will establish an enforceable contractual relationship between you and 2512LS in accordance this Agreement.
This is an Agreement is between 2512 Laundry Service LLC, the service provider, located at 224 West 35th Street, Suite 500, New York, New York 10018 and you, the customer or member, whose identity, address and contact information is as provided during your information gathering interview with our agent.
It shall be a condition of this Agreement that you further acknowledge that we may, at our sole discretion, modify, edit or adjust this Agreement at any time provided that we give you reasonable Notice of our intention to do so. This Notice shall be communicated via the usual means that has been used and accepted prior to its publication. Your continued use and access of our services and products after this Notice has been duly communicated shall constitute your consent to abide by the Agreement as amended. You are further REQUIRED to review this Agreement periodically in order to be appraised of any and all changes made therein.
TYPES OF USERS
The products and services we provide at 2512LS can be accessed by two types of Users; i) The regular customer, and ii) the register Member. For the former the cost for the laundry services shall be the Standard or regular pricing, whereas for the latter the cost of the said laundry services shall be at the agreed discounted rates in accordance with the package deal negotiated.
ACCESSING THE SERVICE
2512LS is an online laundry service that provides pick-up and return delivery of laundry items from the comfort of your home or other location. The User is enabled to schedule the laundry of his/her items via the internet or cellphone messages or calls, after which our employee or agent will arrange to pick-up, process, launder and make drop-off delivery to the pre-arranged location and time.
PREREQUISITE TO ACCESSING SERVICE
Users can access the services and products provided by 2512LS by placing orders online, however, in order, to facilitate the best possible service, 2512LS requires that customers do the following:
i. Make sure the most up-to-date contact information (name, address, apartment #, email, cellular, etc.) is reflected on the order/membership form and other 2512 Laundry Service records; contact 2512 Laundry Service immediately regarding any relevant changes in contact information.
ii. Bag clothing prior to the order pickup; delicate and other special wash items should be separated – to avoid confusion – and instructions clearly checked or noted on the order form.
iii. Make sure all washable goods are ready for prompt pick-up when 2512 Laundry Service delivery staff arrives to avoid “Wait on You Fee.” of $2.99
iv. Upon completion of the job, customers should be available to confirm they will be present at the designated laundry drop-off for delivery of the goods.
v. Customer must notify 2512 Laundry Service in advance regarding any changes to your delivery. In the event Customer is not at the drop-off point. Failure to do so can cause service delays to other 2512 members will do the following:
i. Collect and review order forms; confirm pick-up details.
ii. Pick up clothing at the designated time and place for transport.
iii. Provide basic and custom laundry services and choice of detergent/fabric softener and bleach as indicated on the online customer order form. Detergent/fabric softener substitutions vary depending on availability and accessibility.
iv. Determine whether to proceed or delay service if order form information is missing, unclear and/or the customer is unavailable to resolve the issue(s).
v. Contact customer to schedule/confirm drop-off time. Primary contact will be through text messages; in some cases, customers may be contacted vis email or phone call if/when necessary.
vi. Drop off clothing at the mutually agreed upon time, unless two (2) hours advance notice is provided by the client or 2512 Laundry Service. If 2512 Laundry Service is not able to delivery for a later time that day, 2512 Laundry Service reserves the right to delay delivery based on driver availability and if it can be scheduled without causing delays in service to other customers. In cases of inclement weather, natural disaster, or vehicle/equipment/machinery failure, 2512 Laundry Service may opt to postpone reschedule or cancel pickup or delivery. 2512 Laundry Service will notify customers when such problems arise in case alternate arrangements can be made to complete delivery.
vii. 2512 Laundry Service will make every effort to document and inform customers of missing (i.e. – one of two socks), torn or otherwise damaged items. 2512 Laundry Service staff is trained to assist in loss prevention in the event that such items may not have been bagged before pickup, or lost/damaged during the laundry process, or of circumstances that may prevent timely service and drop-off.
PRODUCTS AND SERVICE PROVIDED
2512LS provides the following products and services; Detergent, fabric softener, bleach; washing, drying, folding, sorting. We may also provide the occasional promotional products and services, also optional customer services as specified by the customer during the order process.
LICENSE
Subject to your compliance with the terms of this Agreement 2512LS grants you limited, non-exclusive, non-transferrable, revocable license to: access and use the online link on your personal device solely in connection with your use of our Services, and access and use any content, information and related material that may be made available through and as a result of the Service, in each case solely for your personal, non-commercial use. Any rights not expressly granted herein are reserved by 2512LS.
USE OF SERVICE
In order to use the products and services provided by 2512, you can either order the Service as: i) an ordinary customer in which you will be charged the standard rates, or ii) a registered member in which you will be given a Membership Identification number (ID#) and will be entitled to special members discounts and benefits for promotional items.
PAYMENT TERMS
a. Customers will be able to pay online via PayPal , Cash App, Zelle, Debit, Credit or Venmo at the time the order is placed or have the choice to pay at the door with the delivery driver free of charge. We do not accept Cash at all.
b. Payment will be made during the order process.
c. If payment cannot be collected due to insufficient funds or other issues, 2512 Laundry Service may charge applicable fees or withhold customer clothing that may be in its possession until the debt is satisfied.
d. Customers are expected to order at least one wash per month in order to have the $3 monthly retainer service fee waived.
9. LATE PENALTY FEES
a. Customers will be charged fees for:
i. No-shows or delaying transport staff from providing timely service to other 2512 Laundry Service customers.
ii. Unclaimed clothing in 2512 Laundry Service’ possession that may have to be housed in storage facilities.
b. Fees will be assessed as early as the same day and normally no later than two (2) business days from the date of the incident or transaction. Storage fees kick in after 7 days. Customers lose rights to unclaimed property in storage after 60 days due to Customer neglect or non-payment for services rendered by 2512 Laundry Service.
LAUNDRY WEIGHT AND ITEMIZING
After you have scheduled your pick-up with our customer service representative, our trained delivery employee/agent will meet you or your representative to pick up and weigh your items on our certified scales and/or count and itemize your garment and where appropriate or necessary take photographs/videos (for exclusive use ONLY). The total weight and/or list of items will be then uploaded to our system and you will receive a notification with the weight and/or number of item in your order. On NO occasion we accept the weight provided by the customer as final, we will always use the weight recorded by our delivery person.
DAMAGE OR LOST ITEMS
In the event that there are any issues as a result of any damage, lost or other concerns that may arise due to the Service provided by 2512LS, be assured that we will make every effort in accordance with accepted industry standards, and all reasonable efforts will be made to accommodate you the customer who have been unfairly inconvenienced.
a. Damaged items: Although we do our best to prevent any damage to your garment or other items, unfortunately every garment or item regardless of its brand, quality or age, will eventually wear out over time some faster than others, and often there is nothing that we can do to avoid it or predict when this will happen. For damage due to normal wear an tear, 2512LS does not provide reimbursement, compensation or replacement.
Per industry standards, the following are considered to be normal wear and tear:
Shrinkage from repeated laundering
Small holes or tears
Discoloration caused by detergent, hygiene or cosmetic products such as deodorant, perfumes and cologne
Button damage or dislodging
Thinning of fabric
2512LS will not be held liable for damaged caused by you not selecting the appropriate laundering service suitable for your items, nor for items left within the clothing or items that eventually causes damage (unless the pocket check service is in effect). Any damaged item must be reported to 2512LS IMMEDIATELY upon being discovered and must not be used or worn thereafter until all the proper assessment is made by 2512LS or their agent.
b. Lost items : while it is never our intention for any item to go missing and is lost, even under the best supervision and surveillance equipment it can happen. If you discover an item missing when your laundry is returned to you, please immediately contact us directly. Notifying the delivery person or some other employee not tasked with the responsibility of treating with this type of situation will be inappropriate and inadequate to properly address the matter. All missing items must be reported to the customer service employee within twenty-four hours of the delivery of the laundry. It is your responsibility to carefully check all laundry in a timely manner on it return to you. All claims are reviewed on a case by case basis, items are considered lost ten (10) business days after the initial claim is made. The decision of 2512LS is final.
c. Reimbursement Guidelines: Any reimbursement for item deemed to be damaged or lost due to the negligence of 2512LS and/or their representative shall be limited to and shall not exceed five (5) times the charge calculated for laundering the said item regardless of its brand, purchase price, condition or sentimental or other value attached to it. Notwithstanding, no reimbursement shall exceed Five Hundred dollars ($500). Any offer made by 2512LS shall be valid for seven (7) days and shall become void and inaccessible thereafter. 2512LS reserves the right to exercise reasonable discretion on a case-by-case basis.
INVENTORY AND UNCLAIMED ITEMS
a. Inventory: 2512LS reserves the right to keep records of your laundry items and retain, store or reproduce such records which may include images and/or photographs and associate such records with your name or other profile information for commercially reasonable periods for archival inventory purposes, quality control, loss prevention, litigation and or data collection.
b. Unclaimed items : upon receiving items through our pick-up/delivery employee or agent, you will be given a receipt together with a Notice warning you that should you fail to make yourself available to collect your laundered items at the agreed time and location, a grace period of five (5) minutes will be provided and thereafter in the case of he regular customer the items will be left unattended at the location, in the case of registered members an additional ten (10) minutes will be facilitated at a cost of $4.99. At the expiration of this additional time the items will ne returned to the laundry and the member will be required to re-schedule another delivery at a cost of $9.99. A storage fee of $9.99 per day for laundered items that are left unreceived for three (3) days after the original scheduled delivery date. 2512LS shall have the right to dispose in whatever way it may choose, any item left unreceived for thirty (30) days after the original scheduled delivery date.
CONDIDENTIAL INFORMATION
a. 2512 Laundry Service safeguards its Customer’s personal information. Debit/credit card information is securely entered via secured PayPal/Cash App/ Zelle/Square/Apple pay accounts that severely limits the amount of financial and personal information that can be gathered while processing payment.
b. Acceptable uses of confidential information:
i. Referral to collection agency regarding storage, late or other fees.
ii. Legal proceedings involving Customer use of illegal payment methods.
INTELLECTUAL PROPERTY
i. Customers will not use 2512 Laundry Service’ trademark, service mark, trade name, logo, ideas, folding concepts and media in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos unless expressly authorized in writing by 2512 Laundry Service executive management.
LIABILITY
a. 2512 Laundry Service will not be held liable for delays in service due to the following:
i. Machinery or equipment failure
ii. Inclement weather (rain, snow, sleet) or natural disaster
iii. Traffic delays or congestion
iv. Failure of customer to follow up with 2512 Laundry Service staff in a timely manner regarding important information relevant to providing and completing timely service.
b. 2512 Laundry Service will not be held responsible for clothing that is left in its possession for more than one week.
2512 Laundry Service may be forced, in some cases, to place clothing in storage that the customer will be responsible to pay for retrieval from.
c. 2512 Laundry Service will not be held responsible for customer errors on the order form that conflict with manufacturer’s care instructions on clothing labels; or for damage that might occur from clothing that is improperly labeled 2512 Laundry Service assumes less responsibility in cases where customers have opted against clothing insurance offered during the order process. Insurance is highly recommended, especially where delicate and expensive clothing are being laundered.
e. 2512 Laundry Service will not be liable for the unauthorized use of other people’s credit/debit and other accounts to pay for clients’ services.
f. 2512 Laundry Service will not be held responsible for any failure by the Customer to secure personal information that may result in identity theft and/or fraudulent claims.
NOTICES
a. All notices and policy changes shall be posted on the 2512 Laundry Service website. Any and all policy changes will be updated on the Company website and viewing of modifications is left under the discretion of the Customer.
17. SEVERABILITY
a. If any provision of this agreement shall be declared by any court of competent jurisdiction to be illegal, void, or unenforceable, the other provisions shall not be affected but shall remain in full force and effect. If the non-solicitation or non-competition provisions are found to be unreasonable or invalid, these restrictions shall be enforced to the maximum extent valid and enforceable.
18. SUCCESSORS AND ASSIGNEES
a. This agreement shall be binding and enforceable to the benefit of the parties hereto and their respective heirs, legal or personal representatives, successors, and assigns.
19. SURVIVAL
a. All provisions that logically ought to survive termination of this agreement shall survive.
20. TERMINATIONN PROVISION
a. If either party breaches any provision of this agreement and if such breach is not cured within thirty (30) days after receiving notice from the other party specifying such breach in reasonable detail, the non-breaching party shall have the right to terminate this agreement by giving written notice thereof to the party in breach, which termination shall go into effect immediately on receipt. Customers may opt to cancel their contract for $24.99. 2512LS further reserves the right to cancel Service for reasonable cause, such as if a delivery location is unsuitable, inaccessible or unsafe, clothing containing offensive odors, unsanitary substances, due to force majeure or inappropriate or abusive activity by you or a third party. In the event of any termination, you will be responsible for paying for Services performed prior to termination.
21. WAIVER
a. Waiver of penalties and fees are determine on a case-by-case basis and are solely at the discretion of 2512 Laundry Service senior executive staff. Customers must provide details and may be asked to furnish proof to substantiate their claims.
22. WARRANTY
a. Except as expressly stated in this agreement, 2512 Laundry Service expressly disclaims and negates any implied or express warranty of merchantability, any implied or express warranty of fitness for a particular purpose, and any implied or express warranty of conformity to models or samples of materials.
b. No advice or information, whether oral or written, given to Customers or members by 2512LS employees or agents during or in connection with the provision of laundry services shall create any warranty.
23. MODIFICATION OF CONTRACT
a. This agreement may be amended or modified in writing to be posted to the 2512 Laundry Service website. Any and all policy changes will be updated on the Company website and viewing of modifications is left under the discretion of the Customer.
